Manhattan Criminal Court Judge James Burke convicted Brady Green, 39, of Dublin, GA, of stalking, harassment, criminal trespass and attempted aggravated harassment, according to the Associated Press.
The crimes carried a possible 90-day jail sentence, but Burke did not sentence the defendant to jail, instead instructing his lawyer, Jeffrey Berman: "Put Mr. Green in a location where he can thrive. And that location is not likely to be the city of New York." The lawyer said he plans to appeal the verdict.
Authorities said Green repeatedly called Banks' studio, showed up there, and sent the talk show host flowers and letters. The man was arrested in March 2008 at a McDonald's restaurant near the studio and told officers at the time that he and Banks "had a thing together," police said.
On Tuesday, Banks testified in court that she feared for her own safety as well as that of her staff, family and anyone else she's with. She said the case prompted her to hire additional security staff and more carefully screen her studio audiences, and is now followed everywhere by security guards, even when she runs and exercises outdoors.
Banks says that even though she is famous, "I don't live that kind of sheltered, protected life -- I like to walk around." She is executive producer and host of two popular TV shows, "America's Next Top Model" and "The Tyra Banks Show."
