TMZ was inside the courtroom when the actor was unexpectedly handcuffed by the bailiff and transferred into custody before the judge even arrived for Sizemore’s probation violation hearing.
Moments later, Sizemore’s attorney filed a motion to transfer courtrooms, claiming that Sizemore would not get a fair shake with the current judge. The judge obliged, and granted the motion — while keeping Sizemore in custody the entire time. Sizemore will remain behind bars until the new judge assigned to the case decides when she wants the hearing to begin. We’re told that Judge Cynthia Rayvis could begin the case as soon as after lunch — or set it for another day entirely.
Tom was arrested last month for using crystal meth outside his hotel, which he later plead not guilty to. The arrest was a violation of a parole stemming from his 2004 drug conviction.
He faces up to sixteen months in state prison if convicted of violating probation.
