The highest court in Malawi overturned a lower court's decision and approved Madonna's adoption request for three-year-old Mercy James, the Associated Press says.
The 50-year-old singer appealed a previous ruling by the lower court that stated she could not adopt Mercy because she had not spent enough time in Malawi, and did not adhere to residency requirements for adoption.
"It's the wee hours of morning in New York but she is excited at the news," Madonna's lawyer Alan Chinula tells the AP. "As her lawyer I am happy that this has settled this contentious issue."
Chief Justice Lovemore Munlo said that Madonna's continuous efforts to help disadvantaged children should have been taken into consideration while the court debated on her adoption request.
According to the AP, the singer's charity Raising Malawi has helped to provide medical care, education, and food to more than 1 million orphans.
