"The Insider" has learned that Kiefer Sutherland will not be prosecuted following an alleged headbutting incident in May. Read on for the details.

The New York D.A. released the following statement to us: "We declined to prosecute after a full investigation. And that included speaking to the complaining witness who was quite uncooperative… Therefore, the D.A. declined to prosecute."

On May 7, Sutherland was charged with assault in the third degree for allegedly headbutting clothing designer Jack McCollough at a nightclub earlier that week.
