Peniche's rep released the following statement to "The Insider":
"Kari Ann is extremely upset over this situation. She considers Eric and Rebecca dear friends and this is an unfortunate incident where consenting adults who were having a little a fun are now victims of having personal property stolen and private matters made public."
The former Miss United States Teen will be appearing on the upcoming season of VH1's show "Celebrity Rehab with Dr. Drew."
Dane's lawyer Marty Singer also released a statement to "The Insider," saying, "This is simply a private consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public."
The actor's lawyer also clarifies that "although the participants are nude, the tape is not a 'sex tape.'" He goes on to stress that the tape is private and was made for his clients' personal use.
