The temporary restraining order stipulates that Giersch must stay at least 100 yards away from Rutherford and their two young children. It's effective through October 15, at which time a court hearing will be held.
In the court papers, the actress accuses her estranged husband of "alarmingly harassing and scary" behavior. "Not only does Daniel harass me, but my child care provider has quit as a result of Daniel's harassment and threats."
She continues, "It is clear that Daniel has begun to follow me, my mother, my nanny and he shows up unexpectedly to threaten and scare us."
Giersch's attorney tells "The Insider" that Rutherford's claims are "fabricated accusations," adding, "Daniel will remain focused on co-parenting both of their children and not make any personal comments in order to continue to protect the children's need for privacy and well being."
The actress filed for divorce from her estranged husband earlier this year, citing "irreconcilable differences."
