Three people, Howard K. Stern, Dr. Khristine Eroshevich and Dr. Sandeep Kapoor, are being investigated for allegedly illegally supplying Smith with drugs before her 2007 drug-related death.
According to the Associated Press, Birkhead said on the stand of Smith, "I don't think I would call her a pill popper," continuing, "But she took more medications than I've ever seen anyone take."
Birkhead said that he mentioned Anna's drug use to Kapoor in 2005, the AP reports. "At the end of the visit, I said to him that she might be taking medicine from someone else in addition to him," Birkhead said.
Birkhead went on to say of his conversation with Kapoor, "He said, 'I believe we have that under control now,' and that's all he said," according to the AP.
Birkhead also testified, the AP reports, that Smith had prescription bottles with false names, and that Kapoor's name was on some of the bottles.
He also said, according to the AP, that he had clashed with Stern, Smith's companion at the time of her death: "We clashed a lot. He would get into the personal relationship between Anna and me." He explained, "I don't think he was happy that I was there." He testified that he saw Stern give Smith a bag filled with methadone and other drugs while she was in the hospital attempting to detox. He said that Smith had asked Stern for the bag but that he didn't see Stern administer any drugs, according to the AP.
Birkhead also testified that he never saw anyone force Smith to take medication, the AP reports.
