Lawyers for Dr. Sandeep Kapoor are petitioning a California court, asking a judge to disregard a request from the Medical Board of California which would prohibit the doctor from practicing pending a possible conviction. The lawyers say in court papers that taking away Kapoor's ability to practice medicine before any possible conviction was a violation of due process rights provided by the constitution.
Kapoor, along with Smith's former companion Howard K. Stern and Dr. Khristine Eroshevich, has been ordered to stand trial on charges of allegedly providing the late star with prescription drugs illegally. The decision was made following a three-week preliminary hearing that was held to determine if the three should stand trial.
"The Insider" learned that Stern faces 11 felony counts, while Eroshevich and Kapoor each face six felony counts. If they are convicted of all charges, each defendant could face more than five years in state prison. All three defendants have pleaded not guilty.
