"The Insider" has obtained the Aspen Police Department affidavit in support of warrantless arrest in which the police report that Sheen's wife Brooke Mueller claimed that "It's happened before" and that Sheen told the responding officer that Mueller threatened to divorce him and take the children.
Officer Rick Magnuson says Sheen told him that the couple began arguing at 3:30 in the morning, about five hours before a 911 call was placed, and that the catalyst of the argument stemmed from a song that Sheen shared with his daughter, "whom he fathered with another woman," and that Mueller "was jealous of this relationship with the daughter."
Magnuson writes that Sheen told him that he and Mueller "had been having marital problems lately" and that she "abuses alcohol." He reportedly denied pushing or striking Mueller -- or threatening her with a knife or strangling her -- but both parties "slapped each other on the arms" and Sheen broke Mueller's glasses. Sheen also reportedly showed the officer a folding knife upon request which he kept in his travel bag.
Mueller then spoke with Officer Valerie McFarlane, reportedly telling her that she told Sheen that "she wanted a divorce and would get custody of the children," and that a reportedly enraged Sheen grabbed her throat and then pulled out a knife, held it to her throat and said, "You better be in fear. If you tell anybody, I'll kill you. Your mother's money means nothing, I have ex-police I can hire who know how to get the job done and they won't leave any trace."
According to the report, Mueller had red marks on the upper part of the front of her neck that she claimed were caused by Sheen and demonstrated how he held a knife to her throat on the bed and said that she feared for her life.
Sheen was then placed under arrest in handcuffs. He posted $8,500 bond at approximately 7 p.m. that evening and is scheduled to face an Aspen judge in court on February 8. A protection order was also issued ordering Sheen to not contact Mueller. He faces possible charges including second degree assault, a class four felony; menacing, a class five felony; and criminal mischief, a class one misdemeanor. All charges are coupled with a domestic violence component.
