Jamie Lynn Spears Baby Daddy, Statutory Rape Charges

It could be only a matter of time before Casey Aldrige is sitting in the clink for statutory rape. Jaime Lynn is a mere 16 years of age. Her boyfriend/baby daddy’s age seems to keep changing with reports ranging from 18 to 20. Whatever the actual number is, he could face charges of statutory rape.

According to the law in California:

California Penal Code 261.5 (the statutory rape law)

• If the minor is less than three years younger than the defendant, the offense is a misdemeanor.
• If the minor is more than three years younger than the defendant, the statutory rape offense may be charged as a misdemeanor or a felony, and punishment can be up to three years state prison.
• It is not a defense that the other person may have consented to the intercourse.

It also doesn’t matter if they were bumping in the bayou either. If they were copulating down in Louisiana he would still face charges and possibly be labeled a sex offender for life.

Felony carnal knowledge of a juvenile is sexual intercourse with consent between (1) someone age 19 or older and someone between age 12 and 17 or (2) someone age 17 or older and someone between age 12 and 15.

The question of whether or not this will be treated celebrity gloves could play. Stars notoriously don’t seem to play by the same rules we regular folk do. Currently Jamie Lynn is said to 12 weeks along in her pregnancy. With a c-list VIP baby momma I doubt he will actually spend time behind bars while Jamie is popping out his kid.

She may also need to look for a new job. Viacom issued a statement dealing with her pregnancy and the Nickelodean fan base of kids and early tweens. They currently support her in her sensitive situation. But no guarantee of continued support was mentioned. Their current “concern is Jamie’s well being.”

You might remember Viacom booted Tom Cruise’s crazy ass for his couch jumping assault and Scientology glibness. I am guessing it is only a matter of time for before an army of soccer moms unite with their pitchforks for a career lynching.
